Attorney Temple wins Suppression Motion in Criminal Case in Dakota County
In the Summer of 2014, the defendant was arrested and charged in Dakota County, Nebraska, for various criminal offenses relating to the operation of a motor vehicle. Ronald E. Temple filed a Motion to Suppress alleging a violation of the defendant’s federal and state constitutional rights. After attempting to resolve the issues fairly to all, the matter proceeded to hearing on the Motion to Suppress. In December 2014, the Honorable Kurt T. Rager ruled in favor of Mr. Temple's client and determined that the “stop of the [defendant's vehicle] was in violation of the Defendant’s rights under the Fourth Amendment to the United States Constitution and Article 1, §7 of the Nebraska Constitution[,]” and ordered that the evidence obtained by law enforcement be suppressed from use by the State. Thereafter, the State dismissed the criminal charge.
